2. WHAT DATA WE COLLECT, WHY WE USE IT AND OUR LAWFUL BASIS
Personal data means information that identifies an individual or could reasonably be used to identify them. It does not include data that has been anonymised so that an individual can no longer be identified.
We may process the following categories of personal data.
Communication Data
This includes communications you send to us through our website, email, Slack, messaging services, social media or other communication channels.
We use this information to communicate with you, provide support, maintain appropriate records and establish, pursue or defend legal claims.
Our lawful basis for processing this information is our legitimate interests in communicating with you, administering our business and maintaining appropriate records.
Customer Data
This includes information relating to purchases of our products or services, such as your name, business name, billing details, email address, telephone number, contact details, purchase information and transaction details.
Payment card information may be processed by our payment providers rather than being stored directly by us.
We use Customer Data to process and administer purchases, supply products and services and maintain appropriate financial and business records.
Our lawful basis is primarily the performance of a contract between you and us, taking steps at your request before entering into a contract, and compliance with our legal obligations where applicable.
Client Service Data
This includes information you provide when working with us as a client, including information provided through onboarding forms, during consultancy sessions, through Slack or other client communication channels, and in documents, business data or other materials you share with us.
Where relevant to the service you have purchased, this may also include audio recordings and transcripts of consultancy sessions.
We process this information to provide our services, understand and analyse your business, develop strategies and recommendations, create agreed deliverables, communicate with you and maintain appropriate records of our work together.
Our lawful basis for processing this information is primarily the performance of our contract with you. We may also process certain information where necessary for our legitimate interests in effectively delivering, administering and improving our services and maintaining appropriate business records.
Event and Community Data
Where you register for or attend an event, networking session, workshop, membership, community or other activity we provide, we may collect information such as your name, business details, contact information, booking details and information reasonably required to organise and deliver the activity.
We process this information to administer your booking or participation, communicate relevant information and deliver the event, community or service.
Our lawful basis will normally be the performance of our contract with you or our legitimate interests in organising and administering our business activities.
User Data
This includes information about how you use our website, online services, communities and other services, together with information you choose to post or submit through those services.
We use this information to operate and administer our website and services, provide relevant content, maintain security and appropriate backups and improve our business.
Our lawful basis is our legitimate interests in properly administering and developing our website, services and business.
Technical Data
This may include your IP address, browser information, device information, time zone, information about how you navigate our website, pages viewed and other technical information about your use of our website and online services.
We may use this information to analyse use of our website and services, administer and protect our website and business, understand the effectiveness of our marketing and improve our services.
Our lawful basis is our legitimate interests in administering, protecting and developing our business and, where legally required, your consent to the relevant cookies or tracking technologies.
Marketing Data
This includes information about your preferences for receiving marketing from us and your communication preferences.
We may use this information, together with other appropriate personal data, to send relevant marketing communications, understand the effectiveness of our marketing and improve how we communicate our products and services.
Our lawful basis will be consent or our legitimate interests, depending on the circumstances and applicable electronic marketing rules.
Sensitive Data
We do not routinely request or collect sensitive personal data unless it is relevant to a service or event we are providing.
You may choose to provide sensitive information where necessary, for example information about your health, disability, accessibility requirements or dietary requirements when completing onboarding, attending an event or otherwise working with us.
Where we process sensitive personal data, we will only collect what is reasonably necessary and will process it where we have both a lawful basis and an appropriate condition for processing under applicable data protection law.
Where appropriate, we may ask for your explicit consent to process this information.
We will only use sensitive information for the purpose for which it was provided unless we are legally permitted or required to use it for another purpose.
We do not intentionally collect information about criminal convictions or offences unless there is a legitimate and lawful reason to do so.
AI and Transcription
We may use artificial intelligence (AI), transcription software and other technology to help us deliver our services. This may include transcribing consultancy sessions, analysing information you provide, organising information and supporting the development of strategies, recommendations and client deliverables.
AI is used as a tool to support our work. We do not use AI to make solely automated decisions about you that produce legal or similarly significant effects. Professional judgement remains part of the services we provide.
Where personal data is processed through AI, transcription or other third-party technology providers, we take reasonable steps to use appropriate services, settings and contractual safeguards to protect your information and to prevent client information being used to train public or third-party AI models.
Our lawful basis for this processing will usually be the performance of our contract with you or our legitimate interests in efficiently delivering and administering our services.
Where sensitive personal data is involved, we will also ensure that an appropriate additional condition for processing applies.
If you do not provide information we need, where we need personal data to perform a contract with you or comply with a legal requirement and you do not provide that information, we may be unable to provide the relevant product or service.
If this happens, we will let you know.
How we use your information
We will normally only use personal data for the purpose for which it was collected or for a reasonably compatible purpose.
If we need to use your information for an unrelated purpose, we will explain the reason and the legal basis for doing so where required.
We may process personal data without your knowledge or consent where this is required or permitted by law.
We do not carry out solely automated decision-making or automated profiling that produces legal or similarly significant effects about you.
3. HOW WE COLLECT YOUR PERSONAL DATA
We may collect personal data directly from you when you:
complete a form
purchase a product or service
complete client onboarding
register for or attend an event
join a membership, community or networking session
communicate with us
participate in consultancy or other client work
interact with our website or online services
We may automatically collect certain Technical Data when you use our website through cookies, analytics and similar technologies.
Please see our Cookie Policy for more information.
We may also receive personal data from third parties where appropriate, including analytics providers, advertising platforms, payment providers and providers of technical or delivery services.
4. MARKETING COMMUNICATIONS
We may send you marketing communications where we have an appropriate lawful basis and where this is permitted by applicable electronic marketing law.
This may include circumstances where you have asked us for information, purchased a relevant product or service or specifically agreed to receive marketing from us.
You can ask us to stop sending marketing communications at any time by using the unsubscribe option provided in our emails or by contacting us at hello@ginatrick.com.
Opting out of marketing communications does not prevent us from contacting you where necessary in connection with a purchase, service, contract or other non-marketing matter.
We will obtain appropriate permission before sharing your personal data with another organisation for that organisation's own direct marketing purposes.
Testimonials and Case Studies
We may invite clients to give us permission to use testimonials, feedback, results or details of our work together for marketing purposes.
Where this would identify you or your business, we will obtain your permission before using the information. Choosing not to give permission will not affect the services you receive from us.
Where permission has been given, you can contact us at any time if you would like to discuss or withdraw permission for future use.
5. DISCLOSURES OF YOUR PERSONAL DATA
We may share personal data where reasonably necessary with:
service providers who help us operate our business and deliver our services, including providers of IT and system administration, website and email services, payment processing, client communication, video conferencing, document storage, transcription and AI technology
professional advisers including accountants, lawyers, insurers and other advisers
government bodies, regulators or other authorities where we are legally required to provide information
third parties where we sell, transfer or merge all or part of our business or assets
We require third parties processing personal data on our behalf to respect the security of that information, comply with applicable data protection requirements and process information for appropriate purposes.
We do not sell your personal data.
6. INTERNATIONAL TRANSFERS
Some of the service providers we use may process or store personal data outside the UK.
Where personal data is transferred outside the UK, we will take reasonable steps to ensure that an appropriate level of protection is in place in accordance with UK data protection law.
This may include transferring data to countries recognised by the UK as providing an adequate level of data protection or using appropriate contractual safeguards or other legally recognised transfer mechanisms.
Where you are based in the European Economic Area (EEA), we will also apply appropriate safeguards where required under applicable EU data protection law.
7. DATA SECURITY
We take appropriate security measures designed to prevent personal data from being accidentally lost, misused, altered, disclosed or accessed without authorisation.
Access to personal data is limited to people and service providers who have a legitimate business need for that information.
Where third parties process information on our behalf, they are required to process it appropriately and maintain suitable confidentiality and security.
We have procedures for dealing with suspected personal data breaches and will notify affected individuals and the appropriate regulator where we are legally required to do so.
8. DATA RETENTION
We will only retain personal data for as long as reasonably necessary for the purposes for which it was collected, including satisfying legal, accounting or reporting requirements.
When deciding how long information should be retained, we consider its nature and sensitivity, the purposes for which it is processed, the potential risks associated with retaining it and applicable legal requirements.
For tax and accounting purposes, we may be required to retain certain information about customers and transactions for six years after the relevant accounting period or relationship.
Client recordings and transcripts
Audio recordings and transcripts created as part of consultancy services will normally be retained for up to 6 months after the relevant session or service, or for the duration of an ongoing client relationship where longer.
This allows us to complete agreed work, maintain continuity throughout our work together and refer back to relevant discussions and decisions where necessary.
Once the client relationship has ended, recordings and transcripts will normally be deleted within 6 months unless there is a legitimate or legal reason to retain particular information for longer.
In some circumstances, we may anonymise information so that it can no longer be associated with you. We may use genuinely anonymised information for research, analysis or statistical purposes without further notice.
9. YOUR LEGAL RIGHTS
Depending on the circumstances, data protection law gives you rights in relation to your personal data. These may include the right to:
request access to your personal data
request correction of inaccurate or incomplete information
request erasure of your personal data
request restriction of processing
object to certain processing
request transfer of your personal data
withdraw consent where we rely on consent as the lawful basis for processing
make a complaint about how your personal data is handled
Not all of these rights apply in every situation.
If you wish to exercise any of your rights, please contact us at hello@ginatrick.com.
You will not normally have to pay a fee to exercise your data protection rights. However, where permitted by law, we may charge a reasonable fee or refuse to comply with a request that is manifestly unfounded or excessive.
We may need to request information from you to confirm your identity before responding to a request.
We aim to respond to legitimate requests within the timeframe required by applicable data protection law. We will let you know if a request is particularly complex or if we are otherwise legally entitled to extend the response period.
Complaints
If you have concerns about how we collect or use your personal data, please contact us at hello@ginatrick.com so that we can investigate and respond.
You also have the right to make a complaint to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection.
If you are based in the EEA, you may also have the right to complain to the relevant data protection authority in your country.

Our website may contain links to third-party websites, plug-ins or applications.
Using those links or enabling those connections may allow third parties to collect or process information about you.
We do not control third-party websites and are not responsible for their privacy notices. We recommend reviewing the privacy information provided by any third-party website or service you use.
